Trademark protection is territorial. A business that registers its mark with the Business Registrations and Licensing Agency in Tanzania has no automatic protection once it begins trading in Kenya, Uganda, Rwanda, or further afield. We regularly see businesses discover this only after a regional competitor has already filed a conflicting mark.

The practical fix is to file a coordinated regional strategy rather than a country-by-country reaction. Where a business has committed to expansion within East Africa, filing in the anticipated markets alongside the home registration is significantly cheaper and faster than pursuing an opposition or cancellation proceeding after a conflict has already surfaced.

Clearance searches matter just as much as the filing itself. A mark that is available in Tanzania may already be registered or in use in a neighboring jurisdiction, and discovering that after significant marketing investment is a costly way to learn it.
